Un petit cours sur les DPI et la taille d'image s'impose...
En premier lieu, les DPI (Dots Per Inch) ne nous sont pas du tout utiles. En fait, les DPI permettent de connaître la résolution d'une image pour une taille physique donnée.
Prenons par exemple une résolution de 90 DPI. Cette résolution peut sembler basse pour certains mais il manque une information primordiale pour juger de cette résolution, soit sa taille d'impression. Sans cette précieuse information, les DPI ne veulent rien dire.
Si nous complétons la résolution de notre exemple (90 DPI) par une taille de 48x72 pouces, nous pouvons ainsi déterminer la résolution pour de plus petits formats, soit, par exemple, un 24x36 qui aurait alors une résolution de 180 DPI ou bien un 16x24 qui aurait une résolution de 270 DPI, ce qui est amplement suffisant dans tous les cas.
Donc, comment calculons-nous les formats disponibles selon votre image?
Nous utilisons les dimensions en pixels, qui nous permettent, une fois calculés, d'obtenir une résolution pour un format donné. Dans notre exemple, la taille en pixels est de 4320 x 6480. Pour savoir quelle sera la résolution d'un 12x18, nous effectuons ce calcul:
4320 px / 12" = 360 DPI
Le calcul devrait donner le même résultat pour la hauteur: 6480/18=360 ce qui confirme que notre image est aussi dans les bonnes proportions.
Vous devez donc nous fournir la plus grande taille d'image sans en augmenter la résolution de manière artificelle*
*Vous savez probablement qu'un logiciel tel que Photoshop est en mesure, à l'aide de techniques de ré-échantillonnage, d'augmenter la résolution ou le compte de pixels d'une image. Par contre, cette technique peut réduire la qualité de l'image au delà de la taille d'origine. C'est pourquoi nous vous recommandons de ne pas augmenter de façon artificielle le nombre de pixels de vos images.

(hereinafter referred to as the "Gallery").

the Artist registering to the ytlab.com portfolio service
(hereinafter referred to as the "Artist").
The Gallery appreciates the artistic value of the Artist's products and wishes to post those products on its online store in order to sell them to its customers;
The Artist wishes to submit a list of products to the Gallery for the purpose of posting them on the online store, printing them and selling those prints to the Gallery's customers;
Definitions: "Artwork" is an image provided by the Artist
In consideration of the matters described above and of the mutual benefits and obligations set forth in this Agreement, the receipt and sufficiency of which consideration is hereby acknowledged, the parties to this Agreement agree as follows:
1. AUTHORIZED SERVICES
1.1 The Artist grants permission to the Gallery to display the chosen Artwork on this site. The Artist also grants to the Gallery a non-exclusive right to promote and sell the Artist's Artwork in return for compensation as set forth in the conditions of this contract.
1.2 The Artist grants permission to the Gallery to sell his Artwork by all means that the Gallery considers appropriate, including online, in store, by a traveling salesperson or by an intermediary authorized by the Gallery, and on any printed format.
1.3 The Artist agrees to provide original Artwork which will be selected for inclusion in the product catalogue at the Gallery's discretion.
2. ARTIST OBLIGATIONS
2.1 The Artist guarantees that the Artwork supplied to the Gallery is original Artwork which has been produced by him or a person directly mandated by him.
2.2 The Artist assumes all costs associated with creating the Artwork prior to submitting the Artwork to the Gallery.
2.3 The Artist will ensure any counting related to limited-edition (numbered) Artwork, and will withdraw from the Gallery any Artwork for which the limited-edition count has been reached. The Artist is responsible for assuming all costs related to documenting and authenticating limited-edition (numbered) Artwork.
3.1 This contract has no fixed term. The Artist may elect to end this contract at any time by contacting the Gallery.
4. ARTWORK PRINTING
4.1 The Artist gives the Gallery permission to print, photograph, film, duplicate electronically or through some other means the Artwork provided for the purposes of selling, promoting or archiving the Artwork. Displaying the Artwork can include but is not limited to: printing the Artwork, displaying the Artwork on the Gallery web site, including the Artwork in promotional material. The Gallery will not alter the Artwork in any way without first obtaining approval on behalf of the Artist, and will respect the reputation and moral rights of the Artist to protect the integrity of his Artwork and the printed versions of the work.
5. ADVERTISING AND PROMOTION
5.1 The Gallery assumes responsibility for all expenses related to advertising the Artwork on the Gallery during the term of this contract.
5.2 The Artist grants the Gallery a non-exclusive right to use the Artist's name, the Artist's biographical image, the Artist's trade name and any other bibliographical materials made available by the Artist and that relate to the Artwork provided by the Artist.
5.3 The Artist will provide, upon request by the Gallery, any documentation and information required to publish the Artist's portfolio on the Gallery. This can include, but is not limited to, biographical notes, catalogues, press articles, press reviews and other texts concerning the Artist. The Artist agrees to maintain this information on a regular basis so as to keep it fresh and accurate.
5.4 The Artist agrees that his Artwork may be displayed on various social media through the Gallery for the purposes of promoting the Artist's Artwork;
5.5 The Gallery will display the Artwork at low resolutions and will apply a watermark to low-resolution images in order to help reduce unauthorized copying and or fraud by a third party.
5.6 Notwithstanding preventative measures outlined in paragraph 5.5, the Gallery cannot be held responsible for fraudulent use of Artwork provided by the Artist. The Gallery will not be held responsible for any damages linked or resulting from such a fraudulent use by a third party, and the Artist will remain the sole owner of the Artwork and as such is the sole person responsible for claiming his copyright on those Artwork.
6. ARTIST DECLARATIONS
6.1 The Artist declares that he is an independent contractor and that nothing in this agreement could be interpreted so as to infer that the Artist would be an agent, employee or associate of the Gallery.
6.2 The Artist warranties that he is not contractually bound to any other agreement that would contradict terms and conditions set forth in this agreement.
7. ARTWORK SALES, REMUNERATION AND TAXES
7.1 During the term of this contract, the Artist will set the price for all his Artwork made available for sale on the Gallery.
7.2 The Artist understands that he cannot demand any payment related to the sale of a particular Artwork until the Gallery has received complete and final payment for the Artwork from the purchaser. To this end, the Artist agrees that once the Gallery has received a final and complete payment for a sold Artwork, the Gallery will pay the Artist within 60 to 90 days following the payment deposit in to the Gallery's accounts.
7.3 The Gallery is responsible for collecting all taxes on sold Artwork and remitting these taxes to the appropriate government authorities.
7.4 During promotional events organized by the Gallery, the Artist agrees that the prices set for the Artwork will be adjusted by the amount of the promotion.
8. INTELLECTUAL PROPERTY AND COPYRIGHT
8.1 The Artist is the sole owner of intellectual property rights that relate to his Artwork. Moral rights related to the Artwork belong to the Artist and will not be transferred to other entities.
ALL SUBMITTED ARTWORK MUST BE ORIGINAL ARTWORK PRODUCED BY THE ARTIST. ARTWORK CANNOT INFRINGE ON ANY THIRD PARTY INTELLECTUAL PROPERTY RIGHTS OR COPYRIGHTS.
8.2 Should the Artwork infringe on intellectual property rights belonging to someone other than the Artist, the Artist will fully indemnify the Gallery for any expenses (including legal expenses) incurred by the Gallery in relation to third party claims about such an infringement.
8.3 The Artist will promptly inform the Gallery of any third party claim relating to intellectual property rights of any Artwork provided by the Artist to the Gallery. In the event of any lawsuit concerning the warranties declarations contained in this contract, the Artist agrees to fully cooperate with the Gallery.
9. BOOK KEEPING
9.1 The Gallery will hold in its accounts a distinct area for the Artist where each transaction is recorded, such as received payments for the Artist's Artwork, the name and addresses of the customer, the number and type of other operations and the total number of Artwork pieces printed and sold.
10. CONTRACT TERMINATION
10.1 This contract will automatically be terminated in the following cases:
- When the Artist is deceased;
- If and when the Artist declares bankruptcy
11.1 The Gallery may transfer or share part of this contract, or this entire contract along with the rights and obligations that relate to it.
12. GENERAL PROVISIONS
12.1 This Agreement will be construed in accordance with and governed by the laws of the province of Quebec. 12.2 The parties to this agreement elect domicile in the judicial district of Montreal.
12.3 The parties agree that each provision of this Agreement will be interpreted in such a manner as to be effective and valid under applicable Law. If one or more provisions of this Agreement are nevertheless held to be prohibited, invalid or unenforceable under applicable Law, such provision will be effective to the fullest extent possible excluding the terms affected by such prohibition, invalidity or unenforceability, without invalidating the remainder of such provision or the remaining provisions of this Agreement.
12.4 The section titles in this contract serve only as reference and do not in any way modify any of its provisions.
12.5 The parties agree to sign (or agree electronically) all documents and take all appropriate required steps to ensure that this contract produces its effect.
12.6 This contract cancels any previous verbal or other previous contract between the parties. The Artist may elect to end this contract at any time.
